Sex offender gets prison time, supervision for life

District Court Judge William Dowell sentenced Charles Russell, 47, to 10 years in prison for third-degree sexual abuse of a child and “committed him to the custody of the Director of the Iowa Department of Corrections for the rest of his life with eligibility for parole ...,” according to court records.
Russell pleaded guilty to third-degree kidnapping and third-degree sexual abuse of a young girl in March.
According to court records, Russell gave the youth a ride and instead of taking her to the correct destination, took her to the Red Wing Access area where he sexually assaulted her.
The special sentencing program begins after Russell completes his prison term and parole.
Russell will have completed the Iowa sex offenders program while in prison, said Dan Fell, director of the Eighth Judicial District Department of Correctional Services.

The High Risk Unit monitors offenders assessed by the Department of Corrections as being at a high risk to commit new crimes.
Fell said that Russell will have home visits by the HRU when he gets out of prison and has completed parole.
In determining Russell's sentence, Dowell took into consideration a presentence investigation that said Russell “was on probation at the time of the commission of these offenses; ... had performed less than satisfactorily while on probation; claims to have a GED (General Educational Development); has a history of substance abuse; a history of emotional problems; is unemployed; and the nature of the offenses ...,” according to the judgment entry.
Russell's prison sentence and special sentence will run consecutive to each other but concurrent to an earlier sentence imposed in another matter.
Russell also must pay a $2,000 total fine, $166 court costs, restitution for court-appointed attorney fees, restitution to the victim if required; a civil penalty of $200; must submit a physical specimen for DNA profiling; and register as a sex offender for the rest of his life.

IF the states would adapt federal sentencing guidelines, that would be the answer. I saw a case where a guy did what would be considered a crime on a state leave which would have left him with a fine.... but with federal, there is actually a chart that puts the crime in a class and a level... there is no plea bargaining, there is no other sentencing that the judge and the attorneys work out, there is simply THAT sentence and the judges generally stick with it. If federal says that person did this amount of harm, then the chart says this is the punishment.
There are toooooo many times these days that people have enough money to get them out of trouble, or they know someone in the courts, or the judge has a kind hearted day, with the federal system... you play, you pay. "

When they get out "sex offenders) have to register at that time. No one is going to goto their house and make sure they actually live at that address. Maybe we should form a citizens group and get the addresses off the Sex Offender List and check it out ourselves. I bed some places are empty and if you find out the person in question isn't living there call the police or the probation office. The police and probation aren't going to do it all. They are way too busy. "

Speaking of school policies, Hamilton Elm has one where they can search your kids body without you being present. Not happening to mine. I can imagine my son being pulled from class/playground,wherever and being searched. He would be freaked out. I had better be notified before they lay a finger on my boy. He is only 6.
Listen to mother of 2, she is right. You just dont know. Maybe a tattoo policy should be in effect for sex offenders, tattoo a big P in the middle of their foreheads. Maybe a sign in their yard, window of their vehicle, everywhere. Halloween is coming up, how many perverts are having thoughts about that skimpy princess outfit your little girl is wearing while they pass out candy?
For goodness sake people, be parents and watch your kids. Have the talk with them about good and bad touches. Start early. If they can name the body part (pee-pee, willy) let them no that nobody is to touch them their unless it is a doctor or parent washing them.
He will get out....he will likely offend again.....she will have a life sentence, I only hope she survives. "

Know the law. Currently a convicted rapist is removed from the Sex Offender Registry once certain criteria are met. It is possible that the man next to you at the race track, the guy that preformed you wedding, or a dad at your child's school is indeed a convicted sex offender and is not registered. This is especially scarey for single women out dating.
Secondly, know your school's policy. Recently a sixteen year old girl in my neighborhood was sexually assualted/harrassed at the local high school. A young man grabbed parts of her body. The young girl reported the incident immediately to staff and to her family. For reasons unknown to me, the young man was not removed from school.
Know your neighbors. I'm reminded from time to time there are sex offenders completely off the grid. There are pedophiles and date rapists that commit crimes over years that just never get caught. Read about warning signs and symptoms. Be aware. The majority of times sexual crimes are committed by someone the victims knows.
As a community, as a country, we need more accountability. "
