Sex offender gets prison time, supervision for life

A Keokuk resident will spend time in prison and be part of a special sentencing program.

District Court Judge William Dowell sentenced Charles Russell, 47, to 10 years in prison for third-degree sexual abuse of a child and “committed him to the custody of the Director of the Iowa Department of Corrections for the rest of his life with eligibility for parole ...,” according to court records.

Russell pleaded guilty to third-degree kidnapping and third-degree sexual abuse of a young girl in March.

According to court records, Russell gave the youth a ride and instead of taking her to the correct destination, took her to the Red Wing Access area where he sexually assaulted her.

The special sentencing program begins after Russell completes his prison term and parole.

Russell will have completed the Iowa sex offenders program while in prison, said Dan Fell, director of the Eighth Judicial District Department of Correctional Services.

“He will be on supervision for the rest of his life,” Fell said. “All sex offenders are referred to the HRU (High Risk Unit).”

The High Risk Unit monitors offenders assessed by the Department of Corrections as being at a high risk to commit new crimes.

Fell said that Russell will have home visits by the HRU when he gets out of prison and has completed parole.

In determining Russell's sentence, Dowell took into consideration a presentence investigation that said Russell “was on probation at the time of the commission of these offenses; ... had performed less than satisfactorily while on probation; claims to have a GED (General Educational Development); has a history of substance abuse; a history of emotional problems; is unemployed; and the nature of the offenses ...,” according to the judgment entry.

Russell's prison sentence and special sentence will run consecutive to each other but concurrent to an earlier sentence imposed in another matter.

Russell also must pay a $2,000 total fine, $166 court costs, restitution for court-appointed attorney fees, restitution to the victim if required; a civil penalty of $200; must submit a physical specimen for DNA profiling; and register as a sex offender for the rest of his life.

" there isn't enough they can do to a sex offender, because that child will have that scar for the rest of her life, she;ll have failed relationships, failed marriages, low self esteem, and the whole ball of wax. He'll get out and go to Flordia where they coddle the foul people of the earth. All I can say is let him be raped day in and day out to see what it's like to be in that situation. As you can tell I'm also a survivor of molestation, right Craig M.And Bill Lam? Once a sex offender, always a sex offender............. Think about it. "

It still makes us feel dirty and like we dont belong in this world. like it was our fault that they did this to us. but regardless there is never enough they can do to make us feel better it is with us for the rest of our lives. But thye will just stop watching him and it will happen again so for the saftey of our kids we need to get this information updated on the daily so they can't hurt them.. "

" Scum like violent sex offenders and child molestors belong in PRISON. While I almost agree, I think they belong six feet under! "

castration doesnt work... wrote on Sep 16, 2008 9:55 AM:

" 1) physical castration is considered cruel and unusual punishment even if voluntarily undergone for a reduced sentence. 2) in humans, at least, the androgens which fuel the sex drive aren't eliminated by physical or chemical castration, only lowered. Castrated males still can perform. Also chemical supplements are available which could counter the surgical effects.

Scum like violent sex offenders and child molestors belong in PRISON. "

" Why couldn't we just castrate these perverts, put them in jail let, them get raped and then set them free. Then he could spend the next few years crying in his pillow not thinking about molesting and raping little kids. I guarantee you this a-hole will get out and do the same thing again. If this guy did this to one of my kids, I hate to say it but he would never make an appearance in court. "

sentencing guidelines... wrote on Sep 13, 2008 7:05 AM:

" For those thinking about committing a federal crime.. go to www.sentencing.us and see what kind of time you are looking at.
IF the states would adapt federal sentencing guidelines, that would be the answer. I saw a case where a guy did what would be considered a crime on a state leave which would have left him with a fine.... but with federal, there is actually a chart that puts the crime in a class and a level... there is no plea bargaining, there is no other sentencing that the judge and the attorneys work out, there is simply THAT sentence and the judges generally stick with it. If federal says that person did this amount of harm, then the chart says this is the punishment.
There are toooooo many times these days that people have enough money to get them out of trouble, or they know someone in the courts, or the judge has a kind hearted day, with the federal system... you play, you pay. "

" I do know that a person doing times gets 1 1/2 day credit for every good day of good behavior. Call ISP and ask some questions. They are very helpful. Only Federal time does a person do all their time. In a state ran facility you don't do anywhere near 70 to 80%. All this is public information, you just need to look into it and you will find answers.

When they get out "sex offenders) have to register at that time. No one is going to goto their house and make sure they actually live at that address. Maybe we should form a citizens group and get the addresses off the Sex Offender List and check it out ourselves. I bed some places are empty and if you find out the person in question isn't living there call the police or the probation office. The police and probation aren't going to do it all. They are way too busy. "

" I don't know what russell will get in terms of his prison term. With his crime and background...it should be longer. That being said, isn't there a way to tell from the state's sentencing guidelines as to how much of the ten years he'll actually spend? 18 months seems rather short. I do know in other state's prisoners customarily do 70 to 80% of their sentence wihich would be 7 to 8 years in this case if those same rules were to apply. I'll bet the County Attorney's office could figure it out. Food for thought. "

S R D Survivor of abuse wrote on Sep 10, 2008 1:11 PM:

" Yep. I figure 18 months maybe. I was molested for 2 year from 6-8 years old by my grandfather. Because I was so young, I didnt get to talk in court and he got 27 days. 27 days!!!!! I spent 2 years in fear every time he ate lunch at my house, when I would bump into him in town, whenever my parents would let him babysit me, even though they KNEW!!! They knew and I would hear them talking about him watching me, figuring I would be safe because my grandma, who threatened to knock my teeth down my throat if I told any stories on him ever again, would keep me safe. Well, she didnt. I call myself a survivor, because the pain might never go away, but I do not use all of the abuse I suffered at the hands of my parents and grandparents as an excuse to neglect or abuse my children. I dont let the past eat me alive. Yes, it is there, sometimes it invades my head, especially when I can feel a childs pain when he or she has been abused, when I read these stories of injustice. I have worked hard to get to where I am today. I do not talk to any of my family. They never held themselves accountable for their actions, still wont to this day. I love my children and make sure they arent left alone with men at all and I am picky about sitters. (In fact, my husband and I have been out one time without the kids in well over a year)
Speaking of school policies, Hamilton Elm has one where they can search your kids body without you being present. Not happening to mine. I can imagine my son being pulled from class/playground,wherever and being searched. He would be freaked out. I had better be notified before they lay a finger on my boy. He is only 6.
Listen to mother of 2, she is right. You just dont know. Maybe a tattoo policy should be in effect for sex offenders, tattoo a big P in the middle of their foreheads. Maybe a sign in their yard, window of their vehicle, everywhere. Halloween is coming up, how many perverts are having thoughts about that skimpy princess outfit your little girl is wearing while they pass out candy?
For goodness sake people, be parents and watch your kids. Have the talk with them about good and bad touches. Start early. If they can name the body part (pee-pee, willy) let them no that nobody is to touch them their unless it is a doctor or parent washing them.
He will get out....he will likely offend again.....she will have a life sentence, I only hope she survives. "

" Lifetime supervision,eh?Would that be like the supervision that the pervert listed on the Iowa Sex Abuser website that has his home listed as 812 s.14th in Keokuk? This house has been vacant for several years.Nobody lives there, let alone the pervert who molested the little girl aged 0-13 years old!It looks to me like whoever is the probation/parole officer for this pervert should either find out where this pervert is or resign their job....they obviously aren't on top of the situation!
I'd name this pervert but it might be seen as harrasment and I don't feel like going to jail for harrassing a pervert. "

Almost victim wrote on Sep 8, 2008 7:39 PM:

" They don't even know if the addresses that the sex offender is giving is where they live. My son was approached by a sex offender here in town several times. There was no sexual crime because he told us immediatly and we went to the police. He is in jail now only because he had been charged previously for sexual crimes in this state and 1 other. He'll be getting out in a year or so I'm sure. You can goto Iowa Department of Corrections and keep track of the person a little. You can also go to a site that is called VineLink.com and you can enter your information and they will call you when the person is either released or moved. There are some things you can do to track youself, but as far as expecting the police to, it won't happen. "

Bye Bye Bud wrote on Sep 8, 2008 6:15 PM:

" bye bye bud...enjoy prison and enjoy a life-time of parole. I'm surprised that Bud didn't try to RAT his way out of the charges as he did rin the late 1980's. Bud should have been locked up years ago but he helped the police catch HIS DRUG BUDDIES and CUSTOMERS instead. I had wondered why the KPD would arrest and charge consumer level drug users with "possession with intent to DELIVER" a trafficking offense until I read the detective's report and saw that Bud had set them up to get himself out of drug-related trouble. Maybe Bud will actually do his time, get no more speical deals, and no more chances to take others down with him. GOOD RIDDANCE "

" This man will get about 18 months, they may watch him from time to time.....and they'll slack off...........he'll be free to ruin another childs life or maybe several childrens. The little girl that he did this to,,, will live with it and the consequences for the rest of her life. She got a life sentence........simply by being an innocent child. "

Mother of a victim wrote on Sep 6, 2008 7:55 AM:

" When will the courts learn once a sex offender always a sex offender. Sex offenders need to stay in prison for the rest of their lives. This is to protect innocent children. Both of my children were victims of sexual assault from their father and he severed his sentence was released and then committed the crime again with his new family. He is now back in prison, but he will be out again in about five years. Five years is not a severe enough punishment for the emmotional damage these offenders cause the victims and their families. "

Mother of Two wrote on Sep 6, 2008 6:51 AM:

" Know the sex offender law. Know your school policies. Know your neighbors.

Know the law. Currently a convicted rapist is removed from the Sex Offender Registry once certain criteria are met. It is possible that the man next to you at the race track, the guy that preformed you wedding, or a dad at your child's school is indeed a convicted sex offender and is not registered. This is especially scarey for single women out dating.

Secondly, know your school's policy. Recently a sixteen year old girl in my neighborhood was sexually assualted/harrassed at the local high school. A young man grabbed parts of her body. The young girl reported the incident immediately to staff and to her family. For reasons unknown to me, the young man was not removed from school.

Know your neighbors. I'm reminded from time to time there are sex offenders completely off the grid. There are pedophiles and date rapists that commit crimes over years that just never get caught. Read about warning signs and symptoms. Be aware. The majority of times sexual crimes are committed by someone the victims knows.

As a community, as a country, we need more accountability. "

" You would get a more time for taking something from Wal-Mart or getting caught with a joint. When are they going to lock this sick son of bit#*#? up and throw the key away. This man has messed with this young person life, why should he get out of prison and do the same to someone else. There is no hope for this pervert! You can not watch him all the time! When will they learn this and leave them in prison for life? "
